Third Party Data Exchange

These additional terms of use apply to you because you have elected to share data relating to one or more Properties you own or occupy to a third party. 

These additional terms, together with the standard HawkEye terms of use as amended or replaced from time to time (which are available on the HawkEye website at www.hawkeye.farm) (the Standard HawkEye Terms), apply to your access to (and use of) the Data. 

Your selection of the add-on for data to be supplied to a third party, and accordingly these additional terms, will continue indefinitely in respect of the Properties for which you have elected to share data until cancelled by either of us in accordance with the Standard HawkEye Terms or these additional terms. 

Cancellation
You may cancel your data sharing agreement between HawkEye and the third party at any time by logging into your HawkEye account. 

Supply of Data
You irrevocably consent to: 

1. Ravensdown requesting Data from the relevant provider, and the relevant provider supplying Data to Ravensdown; and,
2. Ravensdown providing sales information for the selected reporting period based on your Ravensdown invoices if selected by you at the time of data transfer.
3. Where an order has a split invoice between two parties, Ravensdown will provide all sales information to the third party.
4. Ravensdown providing application data information for a period specified by you, based on applications manually recorded, received from a third-party spreading provider or uploaded from a C-Dax spreading unit. Data transfer will only occur if selected by you at time of transfer. 

And acknowledge that Ravensdown may provide to the relevant Provider details of your acceptance of these additional terms as evidence of your consent. 

Definitions
In these additional terms: 

'Data' means information based on your individual Ravensdown and HawkEye accounts based on your unique Ravensdown customer number. This information includes sales, applications, landholdings, land categories, Ravensdown customer name, contact details.  

'Sales information' means sales made by Ravensdown to you or split with another party from a single order based on dispatched quantities.  

'Application information' means fertiliser applications/spreads recorded in HawkEye against your unique Ravensdown customer number. 

'Property' means a property which is operated as a single economic farming unit from both a business and operational perspective, as determined by us.  Factors considered when determining whether a property is a single economic unit include how the property is managed on a day-to-day basis, how the property is treated for accounting purposes and how the property is treated by third party providers.  Factors not considered include the ownership of the property, the geographic continuity of the property, and the variety of the stock or crops on the property. 

'Third Party' means a person or company external to Ravensdown, which at the date of these additional terms includes Fonterra Ltd. 

'Ravensdown, we, us or our' means Ravensdown Limited. 

Amendment
We may amend or replace these additional terms from time to time, in the same manner as we may amend or replace the standard HawkEye terms of use. 

Terms of use for fertiliser data by Fonterra Cooperative Group Limited in the Farm Dairy Records  
Fonterra requests the use of your Ravensdown fertiliser purchase and application records data.  

By accepting these terms and granting access to the Data:  

1. You agree that the Data will be delivered to Fonterra to pre-populate the Farm Dairy Records. 
2. Fonterra will manage all data received in accordance with the Fonterra Farmers' Terms and Conditions of Supply, which you can find in your Fonterra account. 
3. To the extent any of the Data contains information of, or relating to, a third party (e.g. a land owner or sharemilker), you warrant that you have obtained all necessary.
